Terms of Use

1. FAME Model and Talent (FMT) is a Model and Talent portfolio hosting web site, community, and affiliate agent network. FMT provides a hosting service for online portfolios and provides a network of affiliate agents.

It is the responsibility of the user to abide by this agreement and site company. FMT uses various third party payment systems; each user is responsible to review and abide by the rules of those systems.

2. Only you may use your service account. You are responsible for all activity that takes place with your service account. You may not authorize any third party to access and/or use the service on your behalf.

3. In using the service you will obey the law; obey any codes of conduct or other notices we provide; keep your service account password secret; and promptly notify us if you learn of a security breach related to the service.

4. The Service and the Sites contain information, facts and opinions from various individuals and organizations. The Service and the Site is provided on an “as is” basis without warranties of any kind, either expressed implied. Neither FMT nor its affiliates endorse or are responsible for the accuracy or reliability of any opinion, advice or statement on the site.

5. You agree not to post or transmit any unlawful, fake, fraudulent, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, profane, hateful, racially, ethnically or otherwise objectionable material of any kind, including, but not limited to, any material which encourages conduct that would constitute a criminal offense, violate the rights of others, or otherwise violate any applicable local, state, provincial, national or international law. In addition you agree to not post information or correspondence which contravenes Federal, and International Trademark or copyright laws and restrictions in any way. You will be responsible for, and indemnify and hold harmless FMT, its subsidiaries, divisions, affiliates, agents and representatives against, any claim arising from any material that you post or transmit. FMT and its affiliates reserve the right, at their sole discretion, to edit, refuse to post, or remove any material, email addresses, images, and content submitted to FMT.

6. Your use of the Service and the Sites is at your own risk. Neither FMT nor any of its subsidiaries, divisions, affiliates, agents, representatives or licensors shall be liable to you or anyone else for any loss of injury or any direct, indirect, incidental, consequential, special, punitive or similar damages arising out of your access or use of your inability access of use, the Service and the Sites and the information available on the Service and the Sites or arising out of any action taken in response to or as a result of any information available on the Service and the Sites. You hereby waive any and all claims against FMT and its subsidiaries, divisions, affiliates, agents, representatives and licensors arising from your use of the service and the sites and the information available thereon.

7. You may not use the service in a way that harms us or our affiliates, or any customer of FMT; engage in, facilitate, or further unlawful conduct; use any portion of the service as a destination linked from any unsolicited bulk messages or unsolicited commercial messages ("spam"); damage, disable, overburden, or impair the service (or the network(s) connected to the service) or interfere with anyone's use and enjoyment of the service; or resell or redistribute the service, or any part of the service.

8. Any communication or material you post or transmit to the Service and/or the Sites is, and will be treated as, non-confidential and non-proprietary. You assume full responsibility for anything you post or transmit, and you grant FMT and its affiliates the right to edit, copy, publish and distribute any information or content you post or transmit for any purpose.

9. FMT provides message forwarding and web-based email services system for communication between members. The system is intended for sending specific communications regarding assignments and for communications supporting work between our members.

10. The majority of the online advertisements you see on FMT pages are displayed by FMT. However, we allow third-party ad serving companies, including ad networks, to display advertisements on FMT pages.

11. FMT is concerned about controlling unsolicited commercial e-mail, or "spam." FMT has a strict Anti-Spam Policy prohibiting the use of a FMT e-mail account to send spam. While FMT continues to actively review and implement new technology, being cautious about the sharing of your e-mail address while online will help reduce the amount of unsolicited e-mail you receive.

12. All parts of this contract apply to the maximum extent permitted by law. A court may hold that we cannot enforce a part of this contract as written. If this happens, then you and we will replace that part with terms that most closely match the intent of the part that we cannot enforce. The rest of this contract will not change. This is the entire contract between you and us regarding your use of the service. It supersedes any prior contract or statements regarding your use of the service. If you have confidentiality obligations related to the service, those obligations remain in force (for example, you may have been an affiliate agent).

13. FMT has a stated policy regarding the posting of sexually explicit images to its web pages. Sexually explicit images are not permitted on this site. Sexually explicit images include but are not limited to images of sexual intercourse, obvious states of sexual arousal (erections), or overt sexual positions (such as noticeably visible or spread genitalia). Failure to adhere to this restriction will result in the removal of the images, and the disablement of that member portfolio.

14. Please respect the rights of artists and creators. Content such as photos and videos may be protected by copyright. People appearing in content may have a right to control use of their image. You may not share other people's content unless you own the rights or have permission from the owner.

15. As a member of FMT, you will receive email from FMT, including regular email updates, and you may also be contacted by other members seeking to contact or work with you. As new features or member programs and promotions are developed and launched, you will be informed via the postings to the site and also by email. Separately, when email is sent to an undeliverable email address, your portfolio will be disabled. If you discover that your portfolio has been disabled because of outdated contact information, you may provide us with the correct information and we will re-activate your portfolio.

16. This User Agreement and any disputes arising out of or related to the Service and the Sites shall be governed by, and construed and enforced in accordance with, the laws of the Province of Ontario. By your usage of this site constitutes your agreement to, but not limited to, the current conditions listed in this agreement.

17. FMT is not intended for users under the age of 13. If you are 13 years or younger do not submit a portfolio or any personal information.

18. FMT reserves the right to change and modify these rules as appropriate and without notice. We will occasionally update this privacy statement to reflect changes in our services and customer feedback. When we post changes to this Statement, we will revise the "last updated" date at the top of this statement. We encourage you to periodically review this statement to be informed of how FMT is protecting your information.

19. Violation of these Terms and Conditions will cause your membership to be terminated and your profile to be removed from FMT without any notice whatsoever and without refund of any/all monies paid.
